Information Collection and Use

This Agreement is between Digitino Emporium Marketing & Software (Owner of Connectya AI) and the person (natural or legal) accessing or using the Product. These Terms of Service (“Terms”) are an agreement between Digitino Emporium Marketing & Software (Owner of Connectya AI) (“Digitino Emporium LLC,” “we,” “us,” etc.) and you, and govern your use of the Site and all information on or submitted through it.

is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein, including but not limited to Digitino Emporium LLC's Privacy Policy (the “Privacy Policy”), as amended from time to time.

If you are accessing or using the Product on behalf of your company, you certify that you have the authority to accept this Agreement on behalf of your firm. By signing up, accessing, or using the Product, Customer acknowledges its acceptance of this Agreement and consents to be bound by its terms and conditions.

Do not use the Site if you do not agree to the Terms or if your jurisdiction will not honor them. Persons under the age of 13 are not authorized to use the Site.

Cloud Service

"Connectya AI" is a Devtool platform that enables you to build voice AI into your product. Our service includes a versatile API for voice interactions, number provisioning, call handling, and a dashboard for customization and integration—ideal for AI call agents, AI sales apps, or conversational AI companions.

Cloud Service Fees

The pricing pages of the Provider offer information on the various components of the Product and their associated pricing tiers. Customer agrees to pay Provider fees during the Payment Period based on the tier selected at account creation and usage during each Subscription Period. Provider reserves the right to change pricing by notifying the Customer (via email or in-product notice) at least seven days in advance. New pricing takes effect at the start of the next Subscription Period.

Professional Services

Beyond standard support, Connectya AI offers customized professional services including strategic consultations, advanced implementation support, and optimization plans tailored to your needs.

Key Terms

Customer: The entity or individual using the Product. If entered on behalf of a company, “Customer” refers to that company.Effective Date: The date Customer accepts this Agreement.Invoice Period: Monthly or Annually.Payment Period: 1 day from invoice issuance.Provider: Digitino Emporium Marketing & Software (Owner of Connectya AI).Subscription Start Date: Date of Sign-Up.Subscription Period: Pay-as-you-go; billed Monthly or Annually.Non-Renewal Notice Period: At least 30 days prior to the Subscription Period ending.

Claims

This applies to any claim alleging:

Customer Content infringes on intellectual property rights of third parties; orConnectya AI's Cloud Service infringes on third-party intellectual property, when used in compliance with this Agreement.

Arbitration

Disputes not resolved between parties will be handled exclusively by final and binding arbitration under the Federal Arbitration Act, administered by the American Arbitration Association or a similar service. The arbitration will be conducted by one neutral arbitrator, at a mutually agreed location. The arbitrator's decision will be binding and enforceable in court.

In any such proceeding, the prevailing party is entitled to recover reasonable legal fees and costs. This arbitration clause survives any termination of these Terms.

Indemnification

You agree to indemnify and hold harmless Digitino Emporium LLC, its staff, and affiliates from any liabilities, losses, or expenses (including attorney’s fees) that arise from your use of the Site, your violations of this Agreement or third-party rights, or any applicable laws.

Digitino Emporium reserves the right to assume exclusive defense of any claim, in which case you agree to cooperate fully.

Acceptable Use Policy

You agree to:

Follow all applicable laws (especially outside the USA).Not engage in hacking, tampering, phishing, spamming, or spreading malware.Not disrupt services for other users.

Privacy Policy

You agree to only share personal data of third parties if allowed by law or contract, and with appropriate consent. Review our Privacy Policy for full details.

Intellectual Property

All Connectya AI branding, trademarks, and technology (excluding your content) are owned by Digitino Emporium Marketing & Software or its licensors and are protected under IP law. You may not use any Marks without prior written permission.

Violations may result in service termination and/or legal action.

Security Policy

Provider will take commercially reasonable steps to protect the Cloud Service against unauthorized access or tampering.

Publicity Rights

Provider may identify the Customer as a user and display Customer’s logo on its website and marketing materials. Customer grants Provider a royalty-free license for this use.

Customer also allows Provider to use its data (de-identified and aggregated) to train and enhance AI and ML technologies within the product.

Changes to Terms

Digitino Emporium LLC reserves the right to modify these Terms at any time. The current version will always replace older versions.
